Your use of this website constitutes your acceptance of these terms and conditions in their entirety. • All other restrictions or conditions applicable to the order.

SECTION 5 - Payment

The consumers have to make the payment of their orders by the intervention of the website, by means of the one or other one of the offered payment conditions, in particular: credit card Visa, credit card Mastercard, credit card American Express and at debit card.

Each consumer irrevocably and expressly authorizes Restaurant Sushi Sama Inc. to debit from, or to credit to, as the case may be, the account identified by the consumer ah the time the order is made the amount payable in respect of the order made or any adjustments to payments.

Restaurant Sushi Sama Inc. does not warrant that the integrated functions or content of the website will be uninterrupted or error-free, that defects will be corrected, or that this website or the server that makes it available are free of viruses or other harmful components. Restaurant Sushi Sama Inc. does not warrant or make any representations regarding the use of or the result of the use of the material in this site in terms of their correctness, accuracy, reliability, or otherwise. You (and not Restaurant Sushi Sama Inc.) assume the entire cost of all necessary servicing, repair or correction. The above exclusion may not apply to you, to the extent that applicable law may not allow the exclusion of implied warranties. You agree that Restaurant Sushi Sama Inc. will not be responsible or liable for any loss or damages whatsoever, including without limitation, loss of information or programs, loss of profit, loss of revenue, injury, costs and expenses including but not limited to lawyer’s fees, arising from or in connection with the use of or access to, or the inability to use or access, this website, even if Restaurant Sushi Sama Inc., has been advised of the possibility of such damage or loss.

You further agree to indemnify, defend and hold harmless Restaurant Sushi Sama Inc. and its officials, officers, employees, and authorized subsidiaries from and against any liability resulting from your violation or infringement of these terms and conditions and those regarding privacy.

General Sales Conditions

SECTION 1 - Usage conditions

This site can be used by all residents of Quebec of legal age to contract within their respective provincial jurisdictions and who may be governed by legal contracts under applicable law. Restaurant Sushi Sama Inc. makes no declaration to the effect that this website can be used in locations other than Quebec and it is strictly forbidden to access this site from localities deeming either the content or usage of the site to be illegal.

By using this site and creating a profile in order to place an order, you assume entire responsibility to maintain the confidentiality of your user account and password. In addition, you take full responsibility for all business transactions undertaken with your user account.

SECTION 2 - Prices and taxes

Restaurant Sushi Sama Inc. engages to maintain and keep this website up-to-date, reflecting the prices and services in effect. However, the prices are subject to change without notice. The final total of your bill can be seen, where you confirm the order and find a summary description of your order. Please note that the prices are in Canadian dollars and do not include applicable taxes. The taxes are included in the total of your order.

SECTION 3 - Product Availability

Restaurant Sushi Sama Inc. advertises on its websites only items that are actually available for order and delivery. It is possible that certain items may not be available at the time of delivery. In this case, a customer service agent will contact you utilising the information you supplied and which is contained in you customer profile. You may then either modify or cancel your order.

SECTION 4 - Prohibited content and/or activity

The user acknowledges and agrees that Restaurant Sushi Sama Inc. may take any action in its sole discretion against anyone who infringes the rights of any person, including without limitation, removing the offending content from the website or terminating the user account of any user.

SECTION 5 - In addition, the user agrees not to:

• Circumvent, modify, delete, disable or interfere with any security technology of software that is part of this website;
• Collect electronic addresses (including email addresses), passwords or other personal information of other users of the website by any means;

• Use another user’s account without such user’s authorization;

Notwithstanding the foregoing, nothing in the present article can have the effect of limiting any right you may have as a consumer by virtue of any public order laws which may be applicable to you.
